Microsoft project in Greater Noida faces action over unauthorised groundwater extraction

A project site linked to Microsoft in Greater Noida, Uttar Pradesh, has come under regulatory scrutiny for allegedly extracting groundwater without mandatory permissions, prompting action from district authorities.

According to officials, the Gautam Buddh Nagar district’s Ground Water Department has issued a notice to the project following an inspection at its Sector 145 site. The inspection reportedly found around 10 borewells operating without a valid No Objection Certificate (NOC), which is required under state law for groundwater extraction.

Alleged violation of UP Groundwater Act, 2019

Authorities stated that the unauthorised borewells constitute a violation of the Uttar Pradesh Groundwater (Management and Regulation) Act, 2019, which governs groundwater use across the state. The legislation mandates prior approval and regulation of extraction, particularly in areas facing water stress.

Sector 145 in Greater Noida falls within a zone classified as “critical” in terms of groundwater availability, making any unauthorised extraction a significant regulatory concern, officials said. Such areas are subject to tighter controls due to declining water tables and increasing demand from urban and industrial activities.

The case highlights growing tensions between rapid corporate infrastructure expansion and groundwater sustainability in water-stressed urban regions, an issue increasingly relevant for ESG and responsible business practices.

Possible penalties and enforcement action

The notice issued by the Gautam Buddh Nagar Ground Water Department seeks an explanation from the project authorities and may lead to penalties if non-compliance is established. These could include fines, sealing of borewells, and other punitive measures as provided under the Act.

District officials have indicated that the action against the Microsoft-linked project is part of a broader crackdown on illegal groundwater extraction in the region, amid growing concerns over water security in rapidly urbanising parts of western Uttar Pradesh.

The matter is currently under review, and further action will depend on the response submitted by the project authorities and subsequent regulatory assessment.
