Strengthening Child Protection: A Need for Better Implementations of the POCSO Act

Child sexual abuse is one of the gravest threats to the well-being and dignity of children, leaving lifelong physical and psychological scars. Recognizing the urgent need for a dedicated legal framework, India enacted the Protection of Children from Sexual Offences (POCSO) Act in 2012. This landmark legislation aims to provide comprehensive protection against sexual crimes, ensuring justice through stringent penalties and child-friendly legal procedures. However, over a decade since its implementation, significant gaps remain in awareness, training, and enforcement, limiting the Act’s effectiveness.

In this article, Ms. Noopur Singhal, a seasoned advocate practicing in Delhi courts since 2007, examines the key challenges in implementing the POCSO Act and explores solutions to strengthen its impact. As the chairperson Local Committee POSH New Delhi District and the leader of the Uttar Pradesh Anti-Sexual Harassment Council under WICCI, Ms. Singhal has been at the forefront of legal reforms addressing sexual violence. Through her initiative, सshaktaम् Mindz, she actively conducts awareness programs and structured training for schools, equipping educators with the knowledge to safeguard children. With her expertise, she underscores the need for broader awareness, judicial clarity, and systemic reforms to ensure that every child in India grows up in a safe and protected environment.

Strengthening Child Protection: A Need for Better Implementations of the POCSO Act

Children are the foundation of a nation’s future, and ensuring their safety is the collective responsibility of society. One of the biggest threats to children is sexual abuse, a crime that leaves lasting physical and psychological scars. Recognizing the urgent need for legal protection, the Government of India enacted the Protection of Children from Sexual Offenses (POCSO) Act in 2012. This law was important because, before the implementation of this law, there were no definite penal provisions about sexual crimes against minors, except for rape, which was governed under general laws.

The POCSO Act is a complete legal framework that defines different types of sexual offences against children, such as sexual assault, penetrative sexual assault, aggravated sexual assault, and sexual exploitation through pornography. It prescribes strict punishments for offenders so that justice is served. Besides, it gives rights to the child victims and emphasizes confidentiality to keep their identity, as well as that of their families, friends, and schools, secret. Legal procedures are conducted in a child-friendly manner with the help of specialized police, child welfare committees, child protection units, special courts, and support persons. Additionally, it requires the reporting of any suspected sexual abuse, thus becoming a shared societal responsibility.

Despite this new law, there are still many problems to solve. The biggest problem is that many people do not know about this law. This lack of knowledge makes it less effective. Although the government has asked schools to teach about child safety, these efforts are not enough. Most training programs work with the distinction between "safe" and "unsafe" touch exclusively, focusing on children in primary school. Beyond that, however, children are very susceptible to abuse; existing awareness programs do little to illuminate the facets of sexual abuse adolescents confront.

Challenges in Implementing the POCSO Act

One major issue with the current implementation of the POCSO Act is the limited scope of awareness programs. The existing training in schools primarily targets children up to the 5th grade, leaving older children without the necessary knowledge to protect themselves. Since the law defines a child as anyone below the age of 18, it is crucial to provide age-appropriate training for all minors. The challenges and risks faced by teenagers are different from those of younger children. With puberty, increased exposure to social media, and the influence of movies and relationships, adolescents are particularly vulnerable to different forms of exploitation.

Another challenge is the judicial system’s divided stance on consensual relationships among minors. There has been a fair amount of debate regarding whether or not such relationships should be considered a crime under the POCSO Act. Such vagueness frequently leads to complicated legal complications, thus making it difficult for cases to be dealt with fairly by courts. Such guidelines will ensure that justice is both provided and applied fairly.

Empirical studies based on data from the National Crime Records Bureau indicate that the implementation of the POCSO Act has contributed to a decline in the growth rate of sexual offences against children in India. According to other studies, enhancing the quality of life at the state level in India reduces the situation of child sexual abuse cases. Factors such as a favourable sex ratio, a gross enrolment ratio increase in elementary education, the working judiciary, and an increased Public Safety Score enhance measures that minimise such offences. This necessitates a holistic approach: complementing legal measures with social and economic development.

Steps for More Effective Implementation

To strengthen the implementation of the POCSO Act, several measures should be taken:

- Expanding Awareness and Training Programs: There should be structured and age-appropriate training for all children up to 18 years of age. Training should go beyond just "safe" and "unsafe" touch and educate children on online safety, healthy relationships, and recognizing different forms of abuse. These programs should also involve parents, teachers, and carers to create a more informed society.

- Extending Mandatory Training Beyond Schools: Since child abuse can occur at any place where child visits, such as coaching centres, amusement parks, theatres, cafes, hotels and even during travel, it is essential to extend training programs beyond schools. Organizations and workplaces should also be mandated to conduct POCSO training, following the model of the Prevention of Sexual Harassment (POSH) Act. This would create a culture of vigilance and responsibility across all sectors of society.

- Judicial Reforms and Clarity on Consensual Relationships: The judiciary should establish clear guidelines on how to handle cases involving consensual relationships between minors. Without such clarity, the law may be misused, leading to unintended consequences. A balanced approach is required to differentiate between cases of genuine exploitation and those involving mutual consent.

- Strengthening Law Enforcement and Support Systems: Law enforcement agencies should receive specialized training to handle child abuse cases with sensitivity. Special courts should be adequately staffed, and child protection units should be strengthened to ensure swift and effective justice. Victim support systems, including counseling and rehabilitation, must also be expanded.

- Robust Public Awareness Campaigns: A nationwide public awareness campaign should be launched to educate citizens about the POCSO Act and the importance of reporting suspected abuse. Various media platforms, including television, radio, social media, and community programs, should be used to spread awareness. The campaign should target different demographics, ensuring that information reaches every segment of society.

The POCSO Act is a powerful legal tool for protecting children from sexual abuse, but its true potential is yet to be realized due to gaps in implementation. By addressing the shortcomings in awareness, training, judicial clarity, and enforcement, the law can be made more effective. Protecting children is a shared responsibility, requiring collective efforts from the government, educational institutions, law enforcement, organizations, and individuals. Only through a comprehensive and proactive approach can India ensure a safer environment for its children, securing a future where every child is protected from harm. The fight against child sexual abuse must be relentless, and the effective implementation of the POCSO Act is a crucial step toward achieving this goal.
